You retain all ownership rights to content you upload to our Services ("User Content"), including photos, videos, audio recordings, and written memories. By uploading User Content, you grant Alas Artistry a worldwide, non-exclusive, royalty-free license to:
This license terminates when you delete your User Content or close your account, except for content that has been shared with other users or incorporated into completed memorial tributes.

All content, features, and functionality of our Services (excluding User Content) are owned by Alas Artistry and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.
Information about butterfly species, ethical sourcing practices, and educational content provided on our Site is owned by Alas Artistry or used with permission. You may not reproduce this content without permission.

Memorial tributes are handcrafted and customized based on your specifications. Production timelines vary based on complexity of design, butterfly species availability, volume of digital content uploaded, and current production capacity. We will provide estimated timelines at the time of order.
All butterfly specimens used in our memorial art are ethically sourced. We do not capture, harm, or kill butterflies for our products. All specimens are obtained from:
You may request modifications to your memorial tribute design during the design approval phase. Once physical production has begun, modifications may not be possible or may incur additional fees.
Memorial tributes are shipped carefully packaged. We are not responsible for damage incurred during shipping by third-party carriers, though we will work with you and the carrier to resolve any issues. Risk of loss passes to you upon delivery.
Memorial tribute AR experiences are hosted for the period specified in your selected tier:
You will receive notice prior to your hosting period expiration. You may renew or extend hosting for an additional fee. If you do not renew, your AR experience will be archived and no longer accessible.
Each tier includes specified storage limits for digital content. You are responsible for ensuring your content does not exceed these limits.
While we maintain regular backups, you are responsible for maintaining your own copies of all User Content. We are not liable for any loss or corruption of User Content.
We strive to maintain 99% uptime for our AR hosting services, but we do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

Augmented reality experiences require compatible devices and software. We do not guarantee compatibility with all devices, operating systems, or future technology updates.
Each memorial tribute is handcrafted and unique. Natural variations in butterfly specimens, materials, and artistic execution are inherent to handcrafted products and are not defects.
Our products deal with grief, loss, and remembrance. While designed with care and sensitivity, we cannot guarantee that our products will achieve specific emotional outcomes or healing results.
TO THE FULLEST EXTENT PERMITTED BY LAW, Alas Artistry, its officers, directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits or data, emotional distress, business interruption, or loss of goodwill.
Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $500, whichever is less.
Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Alas Artistry, its officers, directors, employees, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of our Services, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.
Founding Partner contributions are non-refundable donations made to support our founding phase, except as required by law.
Once memorial tribute production begins, orders cannot be cancelled. We will work with you during the design approval phase to ensure you are satisfied before production begins. Refunds may be issued at our sole discretion in cases of significant production defects, failure to deliver within reasonable timelines due to our fault, or material misrepresentation of product specifications.
If AR hosting or digital services experience extended outages or failures, we may extend your hosting period or offer other appropriate remedies at our discretion.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last Updated" date, notify you via email, and post a notice on our website. If informal resolution fails, any dispute arising from or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Indianapolis, Indiana, or remotely via videoconference.
Exception: Either party may bring an action in small claims court if the claim qualifies.
You agree that any arbitration or proceeding shall be conducted on an individual basis. You waive any right to participate in a class action against Alas Artistry.
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.

We reserve the right to suspend or terminate your access to our Services at any time for violation of these Terms, fraudulent or illegal activity, behavior that harms other users or Alas Artistry, or extended periods of inactivity.
